Six years ago, Keya Leahey started working with the provincial government to find adoptive parents.
“Soon after, I learned that the prospective adoptive parent assessment policy was not being followed,” Leahey said in her complaint to the inspector.
According to her complaint, applicants and anyone else living in the home cannot have a restraining order, a binding peace or a crime of domestic violence within the past seven years.
Trouble is, Leahey and the other social workers tasked with classifying who will become adoptive parents for the approximately 600 children in the system at any given time cannot obtain that information by testing. Criminal records for which they are allowed to proceed.
“A criminal record check does not provide information on allegations that did not lead to a conviction,” Leahey said in her complaint to the ombudsman.
“These checks also do not provide information on peace pledges, past commitments or convictions under provincial regulations (such as the Motor Vehicle Act).”
The Justice Department looked more closely
Leahey suggested to her supervisor at the time that the social workers checking on adoptive parents were allowed to use the Justice Enterprise Information Network, to be called the JEIN, to conduct information searches on pending criminal charges, peace obligations and charges under provincial law.
“At that time, these searches were often conducted by Justice Department support agents at the request of child protection social workers,” Leahey said.
Those social workers investigated child welfare claims, something Leahey did before she got the job of checking on foster parents.
In a November 2018 email seeking direction from headquarters about JEIN searches, Leahey admitted the system – administered by the Justice Department – could provide incomplete or inaccurate information.
“While this tool may not be perfect, it has been widely used by Nova Scotia judges, police and corrective workers since 2005,” she wrote.
She is constantly forcing her managers to be allowed to do deeper background searches, but with no success.

“I continue to raise concerns,” Leahey said in her complaint in May 2019. “I know a child has been placed in foster care with someone charged with (and not charged). child sexual abuse. In her correspondence with her supervisors, Leahey discussed other issues that arose because social workers were not authorized to use JEIN’s searches to review adoptive parents’ backgrounds.

By the time Leahey knew, a foster child had been in the house for more than a year, she said.
